A development application (DA) to construct a 202 lot housing estate over 10 hectares on Blackhead Road has twice been rejected by MidCoast Council.
The 'refusal of consent' decision is being appealed in the Land and Environment Court by the DA proponents.
Last week a Land and Environment conciliation conference between legal teams representing MidCoast Council and Island Point Plantation, Brichris Pty Ltd and John Earning was conducted on-site.
Five local residents objecting to the development, gave evidence before Land and Environment Court Commissioner, Peter Walsh.
Following the on-site session a closed mediation meeting between the legal teams was scheduled.
However, Commissioner Walsh terminated the session.
The five objectors were advised by Local Government Legal that the matter would return to the court registrar who would make an allocation for a hearing date for future proceedings.
Located on 303 Blackhead Road, access to the planned estate was via Tallwoods Village.
The land is zoned residential (R1).
The 'lifestyle' site proposed affordable living primarily for the retired and elderly.
About 200 Hallidays Point residents attended the on-site court session in support of the five objectors representing the community.
